È prevista il 14 settembre l’esecuzione, tramite iniezione di veleno, di Francis Elaine Newton, una donna di colore condannata a morte nell’ottobre 1988 per l’assassinio di suo marito e dei suoi due figli, avvenuto nell’aprile 1987. Francis Newton è stata giudicata colpevole sulla base di prove indiziarie e professa da sempre la propria innocenza. La Sezione Italiana di Amnesty International pubblica oggi sul proprio sito, www.amnesty.it, un appello rivolto alle autorità del Texas, affinché annullino la condanna a morte.

Nel suo ultimo ricorso, il nuovo avvocato difensore di Newton ha denunciato una serie di irregolarità giudiziarie verificatesi nel processo del 1988 e ha sottolineato che la prova usata per condannare Newton, che al contrario avrebbe potuto provare la sua innocenza, è stata distrutta nel laboratorio del Dipartimento di polizia di Houston. Questo centro, secondo un’inchiesta interna del dipartimento, funziona talmente male che, nell’ottobre 2004, un giudice della Corte d’appello ha chiesto “una moratoria di tutte le esecuzioni nei casi in cui la condanna si sia basata su prove analizzate dal laboratorio”.

Il 7 aprile 1987, a seguito della segnalazione di una sparatoria, un agente di polizia entrò in un appartamento di Houston, trovandovi Francis Newton e sua cugina Sondra Nelms insieme a tre cadaveri: Adrian Newton, marito di Francis, e i due figli Alton di 7 anni e Farrah di 21 mesi.

Durante il processo, Sondra Nelms dichiarò che quella notte sua cugina aveva portato una borsa in un’altra abitazione, prima che entrambe si recassero a casa dei Newton, dove avrebbero rinvenuto i tre corpi. La borsa conteneva una pistola, che fu successivamente indicata come l’arma del triplice delitto. L’unica prova esibita a carico di Newton fu una traccia di nitriti, trovati su una sua maglietta e giudicati compatibili con i residui dell’esplosione di uno o più colpi di pistola.

La pubblica accusa omise di informare la giuria sull’esistenza di una seconda pistola, rinvenuta sulla scena del delitto. La difesa, a sua volta, trascurò di segnalare ai giurati il parere di un gruppo di periti, secondo i quali i nitriti erano particelle di un fertilizzante usato dallo zio di Newton che aveva ospitato nella propria casa, dotata di un ampio giardino, la piccola Farrah mentre la madre era al lavoro.

Nel dicembre 2004, la nuova difesa di Newton riuscì a ottenere un primo rinvio dell’esecuzione per consentire di effettuare un nuovo test sulla maglietta. Ma, come è poi emerso, la traccia di nitriti è stata distrutta nel corso del primo test effettuato dal laboratorio della polizia di Houston.

Sui vestiti, sulle mani o nell’automobile di Newton non furono mai riscontrati residui di sangue, sebbene fosse stato accertato che le tre vittime erano state uccise a bruciapelo. Residui di polvere da sparo non furono trovati sulle sue mani o sul suo maglione.

Dal 1973, 121 condannati alla pena capitale negli Usa sono stati rilasciati dal braccio della morte perché innocenti.

Dear Governor,

I am writing to you as member / supporter of Amnesty International, the non governmental organization that has been impartially campaigning for the defence of fundamental human rights since 1961. I would like to draw your attention to the case of Frances Newton (prisoner number #922), who is scheduled to be executed on 14 September 2005.

Frances Newton was convicted in October 1988 of the murder of her husband and two children in April 1987. She was convicted on circumstantial evidence and maintains that she did not commit the murder.

I express my concern that the date of execution was set despite doubts over the reliability of her conviction which have not been dispelled since her previous stay of execution.

Frances Newton was prosecuted in Harris County and ballistics evidence central to the state's case was processed at the troubled Houston Police Department crime laboratory. Furthermore, I express my deep concern that retesting of crucial physical evidence on Frances Newton's skirt, ordered by your office, has proved impossible due to the mishandling of the evidence by the authorities.

Amnesty International opposes all executions, regardless of issues of guilt or innocence. One of the most compelling arguments against the use of the death penalty is the risk that innocent people may be executed. I remind you that the United Nations Safeguards Guaranteeing Protection of the Rights of Those Facing the Death Penalty prohibits the execution of anyone whose guilt is not based on “clear and convincing evidence leaving no room for an alternative explanation of the facts”.

Finally I urge you to stop the execution and commute the death sentence of Frances Newton immediately.
